What is the Safest Way to Serve Court Papers?

If you’re a process server, you’ve probably run into your fair share of sketchy situations. From high-crime areas to nighttime service attempts, process servers can often have quite a dangerous job. That’s why it’s so important for process servers to always consider not just their own safety while working, but also the safety of everyone in the vicinity. In this post, we’ll go through our top tips for safely serving process here in the Carolinas and beyond.

Consider the Situation

While it’s not a process server’s business to keep up with the legal affairs of everyone they serve, sometimes knowing the type of papers being served can be vital. For example, if you’re serving divorce or child custody papers, planning the service when the spouse or children are not present is the best method. For evictions or foreclosures, emotions can also run high, so approaching in a calm demeanor with de-escalation tactics on hand is key. This will hopefully avoid any spur of the moment violent reaction towards yourself or the other parties involved.

Pick a Public Spot During the Day

While it may be tempting to attempt service to someone at their own home, since this will likely be the easiest place to find them, it’s not always the safest choice. Process servers have been killed during service attempts to private residences, especially if they are secluded or concealed from the eyes of others. A violent person will likely feel less inclined to react aggressively if they are in front of others, so try to serve people in a public spot during daylight hours to minimize the possibility of an incident.

Use Tracking Technology

Modern technology makes easy work of keeping up with where someone is at all times and documenting everything that happened. We recommend that all process servers use a GPS tracker and wear a body camera while on the job to provide an extra layer of proof that they were where they said they were and at the time they said they were there. The body camera footage can dispel any questions about whether the process was served properly as well. However, be mindful of state laws on recording…for example, in North Carolina, it is legal to video record someone in public without their consent, but audio recording might not be allowed.

Wear Protective Gear

Many process servers use protective gear while working such as bulletproof vests, tasers, stun guns, or even actual firearms. Again, it’s important to be aware of state laws on what is and is not allowed, but in general these items are permissible for anyone to carry, and they could save the process server’s life.

Use the Buddy System

For high-risk service attempts we always recommend using the buddy system. It’s best to have another person physically with you, but if that’s not possible, having someone on video call or Facetime is also acceptable. This way another person knows exactly what is happening and can notify law enforcement quickly if anything goes wrong.
